M3DS Academy Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of the M3DS Academy website, student portal, Discord/community spaces (if applicable), and any courses, mentorship, and services provided through our platform (collectively, the “Services”). By accessing the Services or enrolling in any program, you agree to these Terms.

If you do not agree, do not use the Services.

Definitions

For the purposes of this Privacy Policy:

  • M3DS Academy,” “we,” “us,” “our” mean [Legal Entity Name], registered in [Country], with registered address [Address].
  • Student,” “you,” and “your” mean any user who accesses or uses the Services, including trial users and enrolled students.
  • “Enrollment Contract” means the separate signed enrollment agreement governing tuition, duration, payment schedule, and program-specific terms.
  • Content” means course videos, documents, assignments, templates, curriculum recordings, portal content, and any materials provided by M3DS Academy or licensors.
  • Student Work” means artwork, files, models, code, and projects created by you.

Order of Precedence (Very Important)

If there is any conflict between these Terms and your Enrollment Contract, the Enrollment Contract controls for tuition, payment schedule, program length, and enrollment Obligations unless mandatory law requires otherwise.

Website Use & Student Portal Access

Authorized Use

You receive a limited, revocable, non-transferable right to access the Services for personal educational use only.

Account Security

You must keep your login credentials confidential. You are responsible for all activity under your account. Notify us immediately of unauthorized access: [security@m3dsacademy.com].

Prohibited Activities

You must not:

● share accounts, sell access, or allow third parties to use your credentials;

● copy, scrape, hack, reverse engineer, or interfere with the platform;

● upload malware, spam, or illegal content;

● attempt to access other users’ accounts or private systems;

● record mentor sessions or classes without prior written consent (see Section 10).

Suspension of Access

We may suspend or terminate access if we reasonably believe you violated these Terms, the

Enrollment Contract, platform security, or community rules. We may act with or without notice

depending on severity.


Eligibility, Registration, and Technical Requirements

Minimum Age

● You must be at least 16 on the first day of class unless a parent/legal guardian signs the required consents and/or the Enrollment Contract (where applicable).

● If you are a minor, your parent/guardian may be required to sign additional consent forms for participation, data processing, and portfolio showcasing.


Language + Tech Requirements

You must have functional English proficiency and the minimum hardware/software requirements (as published). You are responsible for stable internet access.


Application and Acceptance

Enrollment is confirmed only after:

1. Your application is accepted.

2. You sign the Enrollment Contract, and

3. You satisfy any initial payment obligations required by the contract.

Student Conduct and Community Standards

You must:

● treat mentors, staff, and students respectfully;

● follow academic integrity rules (no plagiarism, cheating, impersonation);

● avoid harassment, discrimination, threats, hate speech, or abusive behavior;

● follow community guidelines (portal/Discord/classroom rules).

Enforcement Process

We may issue warnings, temporary restrictions, suspension, or termination based on severity.

When reasonable, we will:

● notify you of the issue,

● allow you to respond,

● make a decision, and

● apply proportionate actions.

Severe misconduct may result in immediate removal. Refund outcomes (if any) are governed by the Enrollment Contract and mandatory law.


Course Access, Materials, and Platform Availability

Access to Courses

Access is granted once enrollment steps are completed. Program duration and access terms are defined in your Enrollment Contract and program details.

“Lifetime Access” Clarification (If You Offer It)
If your offer includes lifetime access to materials, “lifetime” means:

● access for as long as M3DS Academy maintains the platform and your account remains in good standing,

● subject to payment compliance and these Terms.

Updates and Changes

We may update course content, mentors, schedules, tools, or curriculum to maintain quality and industry relevance. We will not remove the core educational value of the program, and we will communicate material changes when feasible.

Platform Downtime

We aim for high availability but do not guarantee uninterrupted access. Maintenance, outages, or third-party failures may occur.


Intellectual Property and Content Restrictions

Academy Content Ownership
All Content is owned by M3DS Academy or its licensors and protected by IP laws.

Student License

You receive a limited, non-exclusive, non-transferable, revocable license to access Content for personal, non-commercial educational purposes only.

You may not:

● redistribute, resell, publish, upload, or share Content outside the Services;

● create derivative products from our Content;

● use our brand assets without written permission.

Violations may result in termination and legal action.


Student Work Ownership + Portfolio License to M3DS

Your Ownership

You own your Student Work.

License to Showcase (Marketing/Educational)

You grant M3DS Academy a non-exclusive, worldwide, royalty-free license to display your Student Work for:

● marketing and promotion (website, social media, ads),

● educational examples (showcasing student outcomes).

We will credit you where reasonable.

Opt-Out

If you want to opt out of public showcasing, email info@m3dsacademy.com with your request and links/files to exclude. We will honor reasonable requests.

Minors

If you are a minor, we may require parent/guardian written consent before showcasing any Student Work publicly.

Third-Party Tools and Software

Courses may use third-party tools (e.g., Autodesk, Unreal Engine). Your use is governed by their licenses and terms. Educational licenses are typically non-commercial. M3DS Academy is not responsible for third-party tools/services.

Recording Policy (Classes, Mentorship, Calls)

● We may record certain sessions for quality control, training, student support, or internal review, where lawful. If recording occurs, we will provide notice where reasonably possible.

● You may not record mentors, staff, other students, or sessions without prior written consent from M3DS Academy and all participants.

Contract-Based Enrollment and Tuition Obligations

M3DS Academy operates on a contract-based enrollment system.

Commitment to Full Tuition

If you sign an Enrollment Contract, you commit to paying the full program tuition stated in the contract. Installments are a payment convenience, not a subscription.

Withdrawal / Discontinuing Attendance

If you stop attending or withdraw, your financial obligations generally remain as described in the Enrollment Contract, except where mandatory consumer law requires otherwise.

Default and Remedies

If you miss payments or materially breach the contract, we may:

● suspend platform access,

● apply late fees (if stated in your contract),

● pursue lawful collection remedies,

● take legal action where appropriate.

We prefer to resolve issues in good faith contact us early if you have a problem.

Payments, Billing, Failed Payments, and Chargebacks

Accepted Payment Methods

Payments may be made via bank transfer and/or secure payment processors (cards, direct debit, payment links). Payment instructions are provided via invoice or portal.

Failed or Late Payments

If a payment fails (insufficient funds, expired card, blocked card), you must update payment details promptly. We may suspend access until resolved.

Chargebacks / Payment Disputes

If you initiate a chargeback or payment dispute:

● we may temporarily suspend access while investigating,

● we will provide relevant documentation to the payment processor,

● if the chargeback is resolved in our favor, you remain responsible for any outstanding balances and may be responsible for reasonable administrative costs where permitted by law.


Refunds, Cancellation Rights, and Consumer Protections

General Policy

Tuition is generally non-refundable unless:

● your Enrollment Contract explicitly provides refunds, or

● Mandatory law requires a refund/price reduction/other remedy.

EU/UK/EEA Distance-Sales Withdrawal (Digital Content)

If you are a consumer in the EU/EEA/UK, you may have a legal right to withdraw from a distance contract within a set period (commonly 14 days) unless an exception applies.

Important: Where legally required, if you request immediate access to digital content/services, you may be asked to provide:

● express consent to begin performance immediately, and

● acknowledgement that you may lose the withdrawal right once the digital

content/service is delivered or performance begins (as applicable).

We will apply any mandatory consumer rights that apply in your jurisdiction.

Privacy and Data Protection

Your privacy matters. Our collection and use of personal data is described in our Privacy

We use trusted vendors (payment processors, LMS tools) as needed. We implement reasonable security controls. Your rights depend on your jurisdiction (e.g., GDPR rights in the EU/EEA/UK).

User-Generated Content Rules (Uploads, Posts, Community)

If you upload content to our portal/community:

● you confirm you have the rights to upload it,

● you must not upload illegal, infringing, hateful, threatening, or abusive content,

● you must not post private personal data of others without permission.

We may remove content that violates rules or law.

Copyright / IP Complaints (DMCA-Style Process)

If you believe content on our Services infringes your IP, send a notice to:

● your name/contact,

● identification of the work claimed to be infringed,

● identification/location (URL/screenshot) of the allegedly infringing content,

● a statement you have a good-faith belief the use is unauthorized,

● a statement, under penalty of perjury (where applicable), that the information is accurate,

● your signature (typed is OK).

We will review and take appropriate action.

Disclaimers (No Guaranteed Outcomes)

The Services are provided “as is” and “as available.” We do not guarantee:

● specific job outcomes,

● income,

● certification results,

● portfolio acceptance by any studio.

Your results depend on your effort, time, and other factors outside our control.

Limitation of Liability

To the fullest extent permitted by law:

● We are not liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in these Terms excludes liability that cannot be excluded by law (e.g., intentional misconduct, gross negligence where prohibited, mandatory consumer rights).

Student Indemnity

You agree to indemnify and hold harmless M3DS Academy and its staff from claims arising out of:

● your illegal acts,

● infringement caused by your uploads,

● misuse of the platform,

● violations of these Terms.

Termination, Effects, and Survival

Termination by You

You may stop using the public website anytime. Contracted students remain bound by the Enrollment Contract’s payment and program obligations.

Termination by Us

We may terminate or suspend access for violations of these Terms or the Enrollment Contract.

Effects of Termination

Upon termination:

● access may be removed,

● outstanding payment obligations (if any) remain due under the Enrollment Contract (subject to mandatory law).

Survival

Sections that survive termination include (at minimum): IP, payment obligations, liability limitations, indemnity, dispute resolution, notices, and governing law.


Force Majeure

We are not liable for delays or failure to perform due to events beyond reasonable control (e.g., natural disasters, war, internet outages, platform provider failures, strikes, government actions).

We will try to resume services as soon as reasonably possible.

Changes to These Terms

We may update these Terms. Material changes will be posted with an updated “Last Updated” date and may be notified via email or portal. Continued use after changes means acceptance, except where prohibited by law. Changes do not retroactively alter your Enrollment Contract unless agreed in writing.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of North Macedonia, without regard to conflict-of-law rules.

Consumer Rights Carve-Out: If you are a consumer and your local mandatory consumer laws provide protections that override parts of these Terms, those mandatory protections apply.

Courts of competent jurisdiction in [Skopje, North Macedonia] will have jurisdiction, unless mandatory law requires otherwise.

Dispute Resolution (Practical + Professional)

Before formal legal action, both sides agree to attempt good-faith resolution:

1. Email a written complaint to info@m3dsacademy.com with details and requested resolution.

2. Allow 14 days for response and negotiation.

3. If unresolved, either party may proceed under Section 23.

Notices

Legal notices must be sent to:

You: the email address linked to your student account (or stated in your Enrollment

Contract)

Notices are deemed received:

● for email: when sent (unless bounced),

● for mail/courier: upon confirmed delivery.

Severability, Waiver, Assignment

Severability: If a provision is unlawful/unenforceable, the remainder stays effective.

Waiver: Failure to enforce a right is not a waiver of that right.

Assignment: You may not assign your rights/obligations without written consent. We may assign in connection with a merger, acquisition, or restructuring.

Entire Agreement

These Terms, the Privacy Policy, and your Enrollment Contract constitute the entire agreement regarding the Services. No oral statements override written terms.
