RULES
AND Legal
These Terms and Conditions (“Terms”) govern your use of the M3DS Academy website, student portal, Discord and other community spaces, and any courses, mentorship, content and services provided through our platform (collectively, the “Services”). By accessing the Services, ticking the acceptance checkbox at checkout, or enrolling in any program, you agree to these Terms.
If you do not agree, do not use the Services.

1) Definitions
- “M3DS Academy,” “we,” “us,” “our” means M3DS Dooel Skopje, a limited liability company registered in the Republic of North Macedonia, with registered office at Kozle 8, 1000 Skopje, North Macedonia.
- “Student,” “you,” “your” means any user who accesses or uses the Services, including trial users, applicants and enrolled students.
- “Consumer” means a Student who is a natural person acting wholly or mainly outside any trade, business, craft or profession.
- “Business Student” means a Student enrolling on behalf of, or at the expense of, an employer or other commercial entity, in which case the Business Enrollment Addendum applies and consumer protections referenced in these Terms do not apply.
- “Enrollment Agreement” means these Terms together with the Order Confirmation, the Privacy Policy, the Acceptable Use & AI Policy, and any program-specific addendum signed at enrollment.
- “Tuition” / “Total Tuition” means the total fixed price for the entire Program selected at enrollment, regardless of payment schedule.
- “Installment Plan” means a credit-style payment schedule for paying the Total Tuition. An Installment Plan is not a subscription, recurring service fee, or pay-as-you-go fee.
- “Program Term” means the full duration of the Program from start date to scheduled end date, irrespective of the Student’s actual progress, attendance, or completion.
- “Content” means course videos, documents, assignments, templates, curriculum, recordings, portal content, and any materials provided by M3DS Academy or its licensors.
- “Student Work” means artwork, files, models, code, and projects created by the Student in connection with the Program.
2) Order of Precedence
If there is any conflict between these Terms and your Enrollment Agreement, the Enrollment Agreement controls for tuition, payment schedule, program length, and program-specific obligations — unless mandatory law in your jurisdiction requires otherwise.
3) Acceptance of Terms
You accept these Terms by:
- ticking the “I have read and agree to the Terms & Conditions and Privacy Policy” checkbox at checkout or registration; and
- (where applicable) ticking the separate “Immediate access waiver” checkbox referenced in Section 15.
Each acceptance is recorded with timestamp, IP address, account identifier, and the version of the Terms displayed at the moment of acceptance, and is retained by M3DS Academy as evidence for the duration of any limitation period applicable to claims arising under the Enrollment Agreement.
4) Eligibility, Registration & Technical Requirements
Minimum Age
You warrant that you are at least 16 years old on the first day of class. If you are a minor, your parent or legal guardian must (i) co-sign the Enrollment Agreement, (ii) provide written consent to data processing under our Privacy Policy, and (iii) authorize the portfolio license in Section 9.
Capacity & Status
You warrant that you have the legal capacity to enter into binding contracts under the law of your domicile, and you elect at checkout whether you are enrolling as a Consumer or a Business Student. Where there is any doubt, you must elect Consumer.
Language & Tech Requirements
You confirm functional English proficiency. You are responsible for meeting the published minimum hardware/software requirements and for stable internet access. Failure to meet technical requirements does not entitle you to any refund or reduction of Tuition.
Application & Acceptance
Enrollment is confirmed only after:
- your application is accepted by M3DS Academy;
- you sign or click-accept the Enrollment Agreement; and
- you satisfy any initial payment obligation specified in the Enrollment Agreement.
5) Website & Student Portal Access
Authorized Use
You receive a limited, revocable, non-transferable, non-sublicensable right to access the Services for personal educational use only.
Account Security
You must keep your login credentials confidential. You are responsible for all activity under your account. Notify us immediately of unauthorized access at info(at)m3dsacademy.com.
Prohibited Activities
You must not:
- share accounts, sell, transfer or sublicense access, or allow any third party to use your credentials;
- copy, scrape, hack, decompile, reverse engineer, or interfere with the platform;
- upload malware, spam, or illegal content;
- attempt to access other users’ accounts or private systems;
- record mentor sessions, classes or live calls without prior written consent (see Section 13);
- use the Services to compete with M3DS Academy or build a derivative training product.
Suspension of Access
We may suspend or terminate access if we reasonably believe you have violated these Terms, the Enrollment Agreement, platform security, or community rules. Suspension does not reduce or extinguish your Tuition obligations under Section 14.
6) Student Conduct & Community Standards
You must:
- treat mentors, staff, and fellow students respectfully;
- follow academic integrity rules — no plagiarism, cheating, impersonation or misrepresentation of work;
- avoid harassment, discrimination, threats, hate speech, or abusive behavior;
- follow community guidelines on the portal, Discord, and live classes.
Enforcement Process
We may issue warnings, temporary restrictions, suspension, or termination based on severity. Where reasonable, we will (i) notify you of the issue, (ii) allow you to respond, (iii) make a decision, and (iv) apply proportionate action.
Severe misconduct (including harassment, IP theft, or platform abuse) may result in immediate removal without affecting your Tuition obligations under Section 14.
7) Course Access, Materials & Platform Availability
Access
Access to the Program is granted once enrollment steps in Section 4 are completed and any required initial payment has been made.
Updates & Changes
We may update course content, mentors, schedules, software tools, or curriculum to maintain quality and industry relevance. We will not remove the core educational value of the Program and will communicate material changes when feasible.
Platform Downtime
We aim for high availability but do not guarantee uninterrupted access. Maintenance windows, third-party platform outages (Discord, LMS, Zoom, payment processors, etc.), and connectivity failures may occur and do not constitute a breach of these Terms or grounds for refund.
Lifetime / Extended Access
Where a Program offer specifies extended or “lifetime” access to materials, this means access for as long as M3DS Academy continues to maintain the platform and your account remains in good standing, subject to payment compliance and these Terms. We may discontinue legacy materials with reasonable notice.
8) Intellectual Property & Content Restrictions
Academy Content Ownership
All Content is owned by M3DS Academy or its licensors and protected by copyright, trademark, and other intellectual property laws.
Student License
You receive a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access the Content for personal, non-commercial educational purposes only. You may not:
- redistribute, resell, publish, upload, share, stream, or mirror Content outside the Services;
- create derivative training products, courses, tutorials, or compilations from our Content;
- use the M3DS Academy name, logos, certifications, or brand assets without prior written permission.
Violations may result in immediate termination of access (without affecting Tuition obligations) and legal action, including claims for damages, lost profits, and reasonable attorneys’ fees.
9) Student Work Ownership & Portfolio License to M3DS Academy
Your Ownership
You own your Student Work.
Marketing & Educational License
You grant M3DS Academy a perpetual, worldwide, royalty-free, non-exclusive license to display, reproduce, adapt for size or format, and communicate to the public your Student Work, solely for:
- M3DS Academy’s marketing and promotion (website, social media, paid advertising, trade events, festival submissions including The Rookies and equivalents);
- educational examples in current and future cohorts;
- inclusion in M3DS Academy’s student gallery and showreels.
We will credit you where reasonable. This license does not authorize sublicensing of your work to any third-party AI training dataset.
Opt-Out
To opt out of public showcasing, email info(at)m3dsacademy.com with your request and the specific files or links to exclude. We will honor reasonable opt-out requests for future use; we are not required to remove materials already published in offline media (printed catalogues, festival submissions already filed, etc.).
Minors
If you are a minor, M3DS Academy will require written parent/guardian consent before any public showcasing of Student Work.
10) Third-Party Tools & Software
Programs may require third-party tools (including but not limited to Autodesk Maya, ZBrush, Substance Painter, Unreal Engine, Adobe Creative Cloud, Houdini, Blender). Your use is governed by the licensors’ terms. Educational licenses are typically non-commercial — your compliance is your responsibility. M3DS Academy is not liable for third-party tool availability, pricing, license terms, or technical failures.
11) AI Use & Academic Integrity
M3DS Academy programs are skill-development programs designed to teach you to produce original creative work. Use of generative AI tools (including but not limited to ChatGPT, Claude, Gemini, Midjourney, Stable Diffusion, DALL·E, Adobe Firefly, Runway, Sora, and any successor) is permitted only as expressly authorized by the instructor for a given assignment, and only as a reference, ideation, or research aid.
You must:
- Disclose any AI tool used, the specific prompts and parameters, and the iteration chain;
- Personally execute the substantive creative and technical decisions;
- Hold or have a license sufficient for any AI tool used for portfolio or commercial purposes.
Submitting AI-generated output as your own original work, or failing to disclose AI use, constitutes academic misconduct and may result in:
- non-issuance or revocation of completion certificates;
- removal of the work from the M3DS Academy student gallery;
- termination of enrollment in the Program;
in each case without affecting your Tuition obligations under Section 14.
We reserve the right to require working files, layered source files, screen recordings of work-in-progress, and version history to verify authorship.
12) Recording Policy
We may record certain sessions for quality control, training, student support, or internal review where lawful. Where recording occurs we will provide notice to participants where reasonably possible.
You may not record mentors, staff, other students, or any session without prior written consent from M3DS Academy and all participants. Unauthorized recording is grounds for termination of enrollment and may give rise to claims under privacy and copyright law.

14) Tuition, Installment Plans & Acceleration on Default
14.1 Total Tuition
Your obligation under the Enrollment Agreement is to pay the Total Tuition for the Program. The Total Tuition is fixed at the time of enrollment and is consideration for M3DS Academy reserving a place for you in the cohort, allocating mentoring and review hours, and making the entire Program curriculum and platform available to you for the Program Term. The Total Tuition is not a subscription, recurring service fee, or pay-as-you-go fee.
14.2 Installment Plans
Where you select an Installment Plan, the installments are a credit-style schedule for paying the same fixed Total Tuition. Cancelling the Installment Plan, terminating your direct-debit or card mandate, charging back any installment, or ceasing participation in the Program does not reduce, suspend, or extinguish your Total Tuition obligation.
14.3 Default & Acceleration
If you fail to pay any installment within fifteen (15) calendar days of its due date, or breach any other material provision of the Enrollment Agreement, M3DS Academy may by written notice declare the entire unpaid balance of the Total Tuition immediately due and payable. You hereby waive presentment, demand, protest, notice of dishonor, and notice of acceleration to the maximum extent permitted by applicable law.
14.4 Late Fees, Default Interest, Collection Costs
Any unpaid amount shall bear, cumulatively:
- (a) a one-time late fee of EUR 25 per missed installment;
- (b) default interest at the statutory rate for late payment under the Macedonian Law on Obligations from the due date until paid in full, capped at 100% of the principal in accordance with Article 266-a(8) of that Law, or such lower rate as is mandatory under the law of your habitual residence;
- (c) all reasonable and documented costs of collection, including external collection agency fees, court fees, bailiff fees, and attorneys’ fees, to the extent recoverable under the law of the forum.
14.5 Suspension During Default
We may suspend platform access during any period in which an installment is overdue. Suspension does not pause, reduce, or excuse your Tuition obligations.
14.6 Set-Off
You may not set off, deduct, or withhold any amount from a Tuition installment by reason of any claim against M3DS Academy unless the claim has been finally adjudicated by a court of competent jurisdiction.
14.7 Good Faith Resolution
We prefer to resolve payment difficulties in good faith. If you anticipate difficulty, contact us at info(at)m3dsacademy.com before missing a payment. Restructuring requests received before default are reviewed case-by-case; restructuring requests received after default will be reviewed only on payment of accrued late fees and interest.
15) Refunds, Cancellation Rights & Consumer Protections
15.1 General Policy — No Refunds
Outside the limited statutory rights set out below, all Tuition payments are final and non-refundable. Without limiting the foregoing:
- cancellation of an Installment Plan does not generate a refund;
- failure to attend, log in, complete assignments, or progress through the Program does not generate a refund;
- loss of access for breach of conduct, IP, AI, or any other policy does not generate a refund;
- subjective dissatisfaction with mentors, content, peers, or career outcomes does not generate a refund;
- you remain liable for the full Total Tuition under Section 14.
15.2 EU / EEA / UK 14-Day Withdrawal Right
If you are a Consumer resident in the European Union, the European Economic Area, or the United Kingdom, you may have a statutory right to withdraw from the Enrollment Agreement within 14 calendar days of conclusion of the contract under Directive 2011/83/EU (or, for UK Consumers, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013).
15.3 Express Consent & Loss of Withdrawal Right
At checkout you are presented with a separate, un-pre-ticked checkbox reading substantially as follows:
“I expressly request that M3DS Academy begin providing the Program (including access to the learning platform, course materials, mentor allocation, and Discord community) immediately and before the expiration of the 14-day cancellation period that would otherwise apply to me as a consumer under EU Directive 2011/83/EU (or, for UK consumers, the Consumer Contracts Regulations 2013). I acknowledge and agree that, by making this request, I will lose my right of withdrawal once the supply of digital content begins or the service is fully performed, and I will be liable for the full Total Tuition. I understand I can decline this option, in which case my Program access will not begin until the 14-day period expires.”
By ticking that checkbox you (i) expressly request immediate performance and (ii) acknowledge that once supply of digital content begins or the service is fully performed (whichever first), your right of withdrawal is extinguished and you remain liable for the full Total Tuition.
15.4 Pro-Rata Payment Where Withdrawal is Validly Exercised
If you exercise the right of withdrawal during the 14-day period before the supply of digital content has begun and before the service is fully performed (i.e., you did not tick the checkbox in Section 15.3, or you have a non-waivable right under your local law), M3DS Academy is entitled under Article 14(3) of Directive 2011/83/EU to a proportionate payment calculated by reference to the price agreed for the full coverage of the Program Term (consistent with CJEU Case C-641/19 PE Digital).
15.5 No Withdrawal Right for Business Students
The 14-day right of withdrawal does not apply to Business Students or to any contract concluded outside a B2C context.
15.6 Mandatory Local Refund Rights Preserved
Nothing in this Section overrides any non-waivable refund or pro-rata reimbursement right that mandatory consumer-protection law in your country of habitual residence confers on you.
15.7 Refund Mechanics
Where a refund is due under this Section, it will be processed within 14 days of our receipt of your valid withdrawal notice, using the same payment method you used at checkout, less any deductions permitted under Section 15.4.
16) Payments, Currency, VAT, Failed Payments & Chargebacks
16.1 Currency & Pricing
Tuition is quoted in EUR unless the Order Confirmation specifies a different currency. Prices displayed at checkout are inclusive of any applicable VAT for Consumers; B2B prices are exclusive of VAT and the reverse-charge mechanism applies where the Business Student supplies a valid VAT number.
16.2 Payment Methods
Payments are accepted by bank transfer or via secure payment processors (cards, direct debit, payment links). Payment instructions are provided via invoice or the student portal.
16.3 Failed Payments
If a payment fails (insufficient funds, expired card, blocked card, declined direct debit), you must update payment details promptly. We may suspend access until the failed payment is resolved. Failed payments trigger Section 14.3 (Default & Acceleration) once the 15-day grace period elapses.
16.4 Chargebacks & Payment Disputes
If you initiate a chargeback or payment dispute:
- we may temporarily suspend access while we investigate;
- we will provide the payment processor with the click-acceptance log, access logs, completed-assignment records, and communications;
- if the chargeback is resolved in our favor, you remain liable for any outstanding balance and for the reasonable administrative costs incurred by M3DS Academy in handling the dispute (recoverable to the extent permitted by applicable law);
- a chargeback initiated without first attempting good-faith resolution under Section 25 may itself be a material breach of the Enrollment Agreement.
17) Privacy & Data Protection
M3DS Dooel Skopje is the data controller. Our processing is described in detail in our Privacy Policy at [m3dsacademy.com/privacy] and our Cookie Policy at [m3dsacademy.com/cookies], which form an integral part of these Terms.
International transfers to processors based in the United States or other third countries are made under (i) the EU-US Data Privacy Framework where the recipient is certified, (ii) the European Commission’s 2021 Standard Contractual Clauses combined with a documented Transfer Impact Assessment, or (iii) another lawful transfer mechanism.
You have the rights of access, rectification, erasure, restriction, portability, and objection under the Macedonian Law on Personal Data Protection 2020 and (where applicable) the EU/UK GDPR.
Notwithstanding the right of erasure, M3DS Academy will retain financial, accounting and contract-performance records for the periods required by Macedonian commercial, tax and accounting law (typically up to 10 years) and to the extent necessary for the establishment, exercise or defence of legal claims (Article 17(3)(b) and (e) GDPR).

18) User-Generated Content
If you upload content to the portal, Discord, or community spaces:
- you confirm you own or have all necessary rights to the content;
- you must not upload illegal, infringing, hateful, threatening, abusive, sexually explicit, or harassing content;
- you must not post personal data of others without their permission;
- you grant M3DS Academy a non-exclusive, royalty-free license to host, display, and moderate the content within the Services.
We may remove content that violates these rules or applicable law.
19) Copyright & IP Complaints (Notice & Action)
If you believe content on the Services infringes your IP rights, send a notice to info(at)m3dsacademy.com including:
- your name and contact details;
- identification of the work claimed to be infringed;
- the URL or precise location of the allegedly infringing content;
- a statement that you have a good-faith belief the use is unauthorized;
- a statement that the information is accurate, under penalty of perjury where applicable;
- your physical or electronic signature.
We will review and act in good faith within a reasonable time and will provide a counter-notice mechanism for affected users, consistent with Article 16 of the EU Digital Services Act (Regulation (EU) 2022/2065) where applicable.
20) Disclaimers — No Guaranteed Outcomes
The Services are provided “as is” and “as available.” We do not guarantee:
- specific employment or freelance outcomes;
- any level of income;
- pass rates on third-party certifications (Autodesk, Epic Games, Adobe, Maxon, etc.);
- portfolio acceptance by any studio, festival, or jury;
- the continued availability of any specific mentor, software, or third-party platform.
Your results depend on your effort, prior experience, time invested, market conditions, and other factors outside our control.
21) Limitation of Liability
To the fullest extent permitted by applicable law:
- we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages;
- our aggregate liability under or in connection with the Enrollment Agreement shall not exceed the total amount of Tuition actually paid by you to M3DS Academy in the 12 months preceding the event giving rise to the claim;
- nothing in these Terms excludes liability that cannot be excluded by law (including liability for death or personal injury caused by negligence, fraud, intentional misconduct, gross negligence where prohibited, and mandatory consumer rights).
22) Indemnity
You agree to indemnify, defend, and hold harmless M3DS Academy and its directors, officers, employees, and contractors from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from:
- your unlawful acts or omissions;
- any infringement caused by your uploads or Student Work;
- your misuse of the platform or breach of these Terms;
- your breach of any third-party tool license.
23) Termination, Effects & Survival
Termination by You
You may stop using the public website at any time. Enrolled Students remain bound by the Enrollment Agreement’s payment and program obligations.
Termination by Us
We may terminate or suspend your access for any breach of these Terms or the Enrollment Agreement, with or without prior notice depending on severity.
Effects of Termination
On termination:
- your access may be revoked;
- outstanding Tuition obligations remain due under the Enrollment Agreement (subject to mandatory law);
- any portfolio license granted under Section 9 survives.
Survival
The following provisions survive termination: Sections 1, 2, 8, 9, 11, 14, 15.4–15.6, 16.4, 17, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32.
24) Force Majeure
Neither party is liable for any failure or delay in performance to the extent caused by an event beyond its reasonable control, including acts of God, natural disasters, fire, flood, earthquake, war (declared or undeclared), armed conflict, terrorism, insurrection, civil unrest, epidemic, pandemic, public-health emergency, communicable-disease outbreak, government-imposed quarantine or lockdown, government act, executive order, regulatory change, sustained internet outage, sustained outage of essential third-party platforms (including Discord, Stripe, Google Workspace, Zoom, the LMS), cyber-attack, or strike or labour dispute.
The affected party shall notify the other in writing without undue delay and use reasonable efforts to mitigate.
Force majeure does not excuse the Student’s obligation to pay Tuition for any period during which M3DS Academy continues to make the Program reasonably available, including in transitioned or remote form.
25) Changes to These Terms
We may update these Terms. Material changes will be posted with an updated “Last Updated” date and notified to you by email or via the portal. Continued use of the Services after the effective date of the change constitutes acceptance, except where prohibited by law. Changes do not retroactively alter the financial terms of an existing Enrollment Agreement unless agreed in writing.
26) Governing Law, Jurisdiction & Consumer Carve-Out
26.1 Governing Law
The Enrollment Agreement, these Terms, and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Republic of North Macedonia, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.
26.2 Forum
Subject to Section 26.3, the courts of Skopje, Republic of North Macedonia, shall have exclusive jurisdiction over any dispute arising out of or in connection with the Enrollment Agreement.
26.3 Consumer Carve-Out
Nothing in Sections 26.1 or 26.2:
- (a) deprives a Consumer of the protection afforded by mandatory provisions of the law of his/her habitual residence under Article 6(2) of Regulation (EC) 593/2008 (Rome I) (or assimilated UK rules), or equivalent national rules;
- (b) restricts the right of an EU/EEA-domiciled or UK-domiciled Consumer under Articles 17–18 of Regulation (EU) 1215/2012 (Brussels Ia), section 15B Civil Jurisdiction and Judgments Act 1982, or equivalent national rules, to bring proceedings in, or be sued only in, the courts of his/her domicile.
26.4 Additional Submission for Collection Actions
Without prejudice to Section 26.3, and solely for the benefit of M3DS Academy, the Student additionally and irrevocably submits, on a non-exclusive basis, to the personal jurisdiction of the courts of the country in which the Student is habitually resident at the time of enrollment, for the purpose of any action by M3DS Academy to recover unpaid Tuition or related amounts under the Enrollment Agreement. The Student waives any objection to such forum on the grounds of inconvenience, lack of personal jurisdiction, or forum non conveniens to the maximum extent permitted by law.
26.5 Hague Convention
The parties acknowledge that the Hague Convention of 30 June 2005 on Choice of Court Agreements has been in force for the Republic of North Macedonia since 1 March 2025, and that this Section 26 is intended to operate as an exclusive choice-of-court agreement for the purposes of that Convention wherever permitted, and otherwise as a non-exclusive submission.
27) Dispute Resolution
Before initiating formal legal action, the parties agree to attempt good-faith resolution:
- send a written complaint to info(at)m3dsacademy.com with details and the resolution requested;
- allow 14 days for response and negotiation;
- if unresolved, either party may proceed under Section 26.
This pre-action step does not extend any limitation period and does not apply where urgent injunctive relief is required.
28) Arbitration (US-Domiciled Students Only)
If you are domiciled in the United States, any dispute arising out of or in connection with the Enrollment Agreement shall be resolved by individual binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted by videoconference, with the seat in Skopje, North Macedonia, in the English language.
Each party waives the right to participate in any class, collective, or representative action.
This Section does not prevent either party from (i) seeking injunctive relief in a court of competent jurisdiction or (ii) pursuing small-claims-court remedies in the Student’s county of residence.
29) Notices
Legal notices must be sent to:
- M3DS Academy: info(at)m3dsacademy.com
- Student: the email address linked to the student account, or as stated in the Enrollment Agreement.
Notices are deemed received:
- for email: when sent (unless bounced);
- for mail or courier: upon confirmed delivery.
30) Severability, Waiver, Assignment
- Severability. If any provision is unlawful or unenforceable, the remainder remains in full effect, and the unenforceable provision shall be reformed to the minimum extent necessary to achieve the parties’ original commercial intent.
- Waiver. Failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment. You may not assign your rights or obligations without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or restructuring, on notice to you.
31) Accessibility
M3DS Academy is committed to making its Services accessible. Our Accessibility Statement, including contact details for accessibility issues and the standards we work toward (WCAG 2.1 AA where reasonably feasible, in line with the EU Accessibility Act 2019/882), is available at [m3dsacademy.com/accessibility].
32) Entire Agreement

- profile photo (where you upload one);

- login times, IP address, device and browser identifiers;
- two-factor authentication data where enabled.

- the program(s) you applied to and were accepted into;
- the Enrollment Agreement, payment plan, and any addenda;
- attendance, progress, assignment submissions, mentor feedback, grades, and certificates;
- portfolio work and student projects.
3.4 Payment & Financial Data
- billing name, billing address, VAT number (for Business Students);
- payment method type and last 4 digits / token references (full card numbers are processed by our payment processors and never stored on M3DS servers);
- invoices, receipts, refund records, chargeback records;
- collection records where applicable.
3.5 Communications Data
- emails, support tickets, chat messages, Discord messages within M3DS-operated channels;
- recordings of live classes and mentor calls (where notified);
- survey responses, testimonials, reviews.
3.6 Technical & Usage Data
- IP address, device type, operating system, browser type and version;
- pages visited, time spent, click paths, referring URL;
- cookie identifiers (see Cookie Policy);
- video playback statistics (where applicable);
- error logs and diagnostic data.

- Email-marketing platform — newsletters, transactional and (with your consent) marketing emails
- Web analytics providers — aggregated traffic and engagement analytics (subject to your cookie consent)
6.5 AI & Productivity Tools
- Anthropic PBC, OpenAI, and similar providers — internal productivity tools used by our staff. Student personal data is not used to train third-party AI models.
6.6 Professional Advisors & Authorities
- accountants, auditors, lawyers, debt-collection agencies (where engaged);
- courts, tax authorities, and regulators (where legally required).
6.7 Acquirers / Successors
In the event of a merger, acquisition, restructuring, or sale of all or part of our business, personal data may be transferred to the acquirer or successor entity, subject to appropriate confidentiality protections.

7) International Data Transfers
Some of our processors are based in the United States or other countries outside the European Economic Area, the United Kingdom, and North Macedonia. When we transfer personal data internationally, we rely on one of the following lawful transfer mechanisms:
- EU–US Data Privacy Framework (DPF) where the recipient is DPF-certified (Stripe, Google, Discord, Zoom, and others have certified to the DPF where applicable);
- European Commission 2021 Standard Contractual Clauses (SCCs) combined with a documented Transfer Impact Assessment;
- UK International Data Transfer Agreement (IDTA) or UK Addendum to the EU SCCs for transfers from the United Kingdom;
- where neither is available, we rely on a derogation under Article 49 GDPR, such as your explicit consent or the necessity of the transfer for the performance of our contract with you.

8) Retention of Personal Data
We retain personal data only for as long as necessary for the purposes for which it was collected, plus any additional period required by law or to defend legal claims:

After the applicable period, we delete or irreversibly anonymize the data.
Notwithstanding the right to erasure, we will retain financial, accounting and contract-performance records for the periods stated above to comply with our legal obligations (Art. 17(3)(b) GDPR) and to establish, exercise, or defend legal claims (Art. 17(3)(e) GDPR).
9) Your Rights
Subject to the conditions in the GDPR, the UK GDPR, and the Macedonian Law on Personal Data Protection (LPDP), you have the right to:
- Access — obtain confirmation of whether we process your data and a copy of the data;
- Rectification — have inaccurate or incomplete data corrected;
- Erasure (“right to be forgotten”) — request deletion of your data, subject to the exceptions in Section 8 above;
- Restriction of processing — limit the way we use your data in defined circumstances;
- Data portability — receive your data in a structured, commonly used, machine-readable format and transmit it to another controller;
- Object — object to processing based on our legitimate interests, including direct marketing (an objection to direct marketing is always honoured);
- Withdraw consent — for any processing based on your consent, without affecting the lawfulness of processing carried out before withdrawal;
- Not to be subject to automated decision-making — we do not use automated decision-making (including profiling) that produces legal or similarly significant effects on you;

10) Marketing Communications
We send marketing communications only to recipients who have opted in via a freely-given, specific, informed, and unambiguous consent (e.g., an unticked checkbox at enrollment or newsletter signup). You can withdraw consent at any time by:
- clicking the “unsubscribe” link in any marketing email;
- updating your preferences in the student portal;

Service-related communications (payment reminders, course updates, policy changes, system notifications) are not marketing and are sent on the basis of contract performance — these cannot be opted out of for as long as your account is active.
11) Children & Minors
The Services are intended for users aged 16 and older. Where a Student is a minor (under 18), the parent or legal guardian must:
- co-sign the Enrollment Agreement;
- provide written consent to data processing under this Policy;
- authorize any portfolio license under the Terms.
We do not knowingly collect data from children under the digital-consent age applicable to the user’s residence (16 in most EU Member States; 14 in North Macedonia). If we become aware that we have inadvertently collected such data without proper consent, we will delete it promptly.
12) Security
We implement appropriate technical and organizational measures to protect personal data, including:
- encryption of data in transit (TLS 1.2+) and of sensitive data at rest;
- access controls, role-based permissions, and the principle of least privilege;
- multi-factor authentication for staff;
- regular security reviews, vulnerability scanning, and patching;
- staff confidentiality obligations and privacy training;
- written data-processing agreements with all subprocessors;
- incident-response procedures.
No system is 100% secure. In the unlikely event of a personal-data breach affecting your rights, we will notify the competent supervisory authority within 72 hours and notify you without undue delay where required by law.

You have the right to lodge a complaint with a data-protection supervisory authority, in particular in the country of your habitual residence, place of work, or place of the alleged infringement.

1) Our Commitment
We believe creative education should be open to everyone. We work to ensure our digital experience — from our marketing website to the student portal, video lessons, live classes, and community spaces — can be perceived, operated, and understood by people with a wide range of abilities.
We treat accessibility as an ongoing process, not a one-time project. As we add new features and content, we test, iterate, and improve.
2) Scope of This Statement
This Accessibility Statement covers:

portal.m3dsacademy.com/, kids.m3ds.academy and parents.m3ds.academy);
- our student portal and learning management system;
- video lessons hosted on our platform;
- live online classes (where conducted via Zoom or equivalent);

It does not cover third-party tools and platforms outside our direct control (Autodesk, Unreal Engine, ZBrush, Adobe Creative Cloud, etc.). Those tools are governed by their own accessibility statements.
3) Standards We Work Toward
We aim for our digital services to substantially conform to:
- the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, published by the W3C;
- the harmonized European standard EN 301 549 (the technical baseline for the EU Accessibility Act, Directive (EU) 2019/882, in force from 28 June 2025).
We follow the four POUR principles:
- Perceivable — information and interface components must be presentable to users in ways they can perceive (e.g., text alternatives, captions, sufficient contrast);
- Operable — interface components must be operable (e.g., keyboard accessible, sufficient time, no content known to cause seizures);
- Understandable — information and the operation of the interface must be understandable (e.g., readable text, predictable behavior, error identification);
- Robust — content must be robust enough to be interpreted reliably by a wide variety of user agents, including assistive technologies.
4) Conformance Status
We are working toward full WCAG 2.1 AA conformance across the Services.
Current status: Partially conformant — meaning some parts of the content do not yet fully meet the WCAG 2.1 AA standard. We are actively working to close known gaps (see Section 5).
We carry out regular accessibility reviews using a combination of automated testing tools, manual evaluation, and user feedback. The next scheduled review is November 2026.
5) Known Limitations
We are aware of, and working to address, the following limitations:
- Older video lessons recorded before our captioning workflow was standardized may not yet have professionally produced captions. Auto-generated captions are available for most older videos and we are progressively replacing them with human-reviewed captions.
- Complex 3D and visual content in some lessons may be difficult to convey by alternative text alone. Where this is the case, instructors provide spoken descriptions and supplemental written walkthroughs.
- Live classes rely on the accessibility features of the underlying video-conferencing platform (Zoom). Real-time captioning is available where supported by that platform; please contact us in advance if you need to confirm specific accessibility features for an upcoming live class.
- Discord community accessibility is determined by Discord’s own platform features, which are outside our direct control. We follow Discord’s recommended practices for inclusive moderation and channel structure.
- Some legacy PDF resources may not yet be fully tagged for screen readers. We are migrating to accessible HTML alternatives.
If you encounter an accessibility barrier we have not listed here, please tell us so we can prioritize it.
6) Compatibility with Browsers and Assistive Technology
The Services are designed to be compatible with the latest two major versions of:
- Browsers: Chrome, Firefox, Safari, Edge;
- Screen readers: NVDA, JAWS, VoiceOver, TalkBack;
- Operating systems: Windows 10/11, macOS, iOS, Android.
We aim to support keyboard-only navigation throughout the Services. We do not officially support browsers more than two major versions out of date or browsers no longer receiving security updates.

11) Micro-Enterprise Note
Where M3DS Academy qualifies as a micro-enterprise providing services under Article 4(5) of Directive (EU) 2019/882 (fewer than 10 staff and turnover/balance sheet not exceeding EUR 2 million), the substantive service obligations of the EU Accessibility Act do not apply by operation of that exemption. Notwithstanding any such exemption, we maintain this Accessibility Statement and continue to pursue the standards described in Section 3 as a matter of policy and good practice.
